Welcome to Live & Connect! These general terms and conditions apply to the use of our website www.liveandconnect.com, the products and services offered by Live & Connect, and your interaction with our content, designs, and materials. By using the website, you agree to these terms.
A purchase order is placed under the express acceptance by the buyer of the following general order and sales terms, which are considered to be known by the buyer.
1. Ordered products and technical specifications
1.1 Product knowledge:
By placing an order, the buyer confirms knowledge of the ordered products, including their dimensions, weight, and technical specifications. This also includes maintenance recommendations and special care instructions for the upkeep of the products as described on the website.
1.2 Color and texture variations:
The buyer is aware that there may be color and texture variations or possible minor imperfections in the products, as described in the “Technical Specifications” section. By placing an order, the buyer accepts these variations.
2. Ordering and payment
2.1 Order:
An order becomes effective only when the deposit has been received, unless otherwise agreed. Any changes or comments can be communicated via reply mail.
2.2 Payment:
Deposits and invoices are payable under the terms specified in Live & Connect’s quotation, unless otherwise agreed in writing. The final balance must be paid upon collection of the order. We accept various payment methods and process payments via secure external payment systems.
3. Packaging and delivery
3.1 Packaging:
The price of the products includes basic packaging suitable for individual transport. However, this packaging is not suitable for international or bulk transport, for which special packaging is required. The additional cost for special packaging will be indicated separately.
3.2 Delivery timeframe:
The delivery timeframe is an estimate and may be extended due to circumstances such as holidays or production issues. The stated timeframe starts upon receipt of the deposit and refers to the period in which the products are ready for transport to the buyer.
4. Liability and guarantees
4.1 Warranty:
The products are guaranteed against manufacturing defects for a period of one year. The warranty is void if changes are made to the original design or if the maintenance recommendations are not followed.
4.2 Cosmetic damage:
The warranty does not cover cosmetic damage, such as scratches, dents, or color variations, unless this damage is immediately reported upon delivery and noted in the condition report.
5. Order cancellation
5.1 Cancellation by the buyer:
If the buyer cancels the order within 4 weeks of placing it, the buyer will be liable for 50% of the sale price. After 4 weeks, the cancellation fee will be 80% of the sale price.
6. Storage fees
6.1 Free storage:
After the delivery of the goods, Live & Connect offers a one-month free storage period. During this period, the goods can be collected without additional charges.
6.2 Storage after free period:
If the goods are not collected within the free storage period, storage fees of €60 per month will be charged. If collection occurs mid-month, the amount will be calculated pro-rata.
6.3 Standard application:
These storage fees will be automatically charged unless otherwise agreed upon in writing with the client.
7. Force majeure and delays
7.1 Force majeure:
In the event of force majeure (such as production or transport issues, or situations like the COVID-19 pandemic), the delivery time may be extended. Delays caused by force majeure cannot result in the termination of the sales agreement, nor can compensation be claimed.
8. Transport and customs
8.1 Buyer’s responsibility:
The buyer is responsible for transport, insurance, and customs clearance of the ordered goods. If the buyer asks Live & Connect to arrange transport, these costs must be paid in advance.
8.2 Third-party transport:
Live & Connect acts solely as an intermediary for transport and cannot be held responsible for any damage during transport.
8.3 Condition report:
Each product will be photographed 360 degrees and checked for cosmetic damage before dispatch.
8.4 Inspection of packaging:
The packaging must be inspected immediately upon arrival. If damage is visible, the contents must be checked in the presence of the carrier. The carrier must confirm this in writing. Any complaints must be submitted in writing within 8 days and emailed to: info@liveandconnect.com.
9. Intellectual property
9.1 Ownership of content:
All designs, photos, logos, text, and other materials on the Website are the property of Live & Connect or our licensors. The content may not be copied, distributed, adapted, or otherwise used without written permission.
9.2 User content:
By submitting content on the website or social media (such as feedback or images), you grant Live & Connect a non-exclusive, royalty-free license to use this content for commercial purposes.
10. Applicable law and dispute resolution
10.1 Applicable law:
These terms are governed by the laws of the Netherlands.
10.2 Dispute resolution:
In the event of a dispute, the parties will first attempt to resolve the issue through mediation before bringing the dispute before the competent court.
11. Changes to the terms
Live & Connect reserves the right to modify these terms at any time. The changes will be posted on the Website with the “Last updated” date. It is your responsibility to review these terms regularly. By continuing to use the website after the changes are made, you accept the updated terms.
